This is an appeal from a judgment sustaining a jury verdict finding plaintiff Schuster 80 percent negligent and the defendant
St. Vincent Hospital 20 percent negligent in respect to plaintiff's fall in a bathtub while a patient at the hospital. The
judgment dismissed plaintiff's complaint. Milton Schuster was admitted to St. Vincent Hospital (hereinafter Hospital) on July 12, 1961, for treatment of a constipation
condition that followed an attack of the flu. Schuster was completely ambulatory and drove to the hospital for the treatment.
He was given a private room with an adjoining bath. By the following day his physician was satisfied with his condition and
said he could be released, but suggested he might stay until the next morning since the room was paid for.
