This is a suit commenced by Sidney A. Schuster to reform a fire insurance policy and for judgment on the reformed policy. The defendant Germantown Mutual Insurance Company issued to Schuster a standard fire insurance policy for a term of three years from July 27, 1966, insuring him to the extent of $10,000 for loss by fire to restaurant supplies and food stuffs located in a warehouse at Tunnel City, Wisconsin. About four months later on November 10th Schuster moved the insured personal property from the warehouse to his newly constructed motel premises near Tomah, where the property was destroyed by fire on March 8, 1967. The plaintiff filed a claim for the loss which was denied on the ground the insured property was removed from the location named in the policy without notice or permission. After answering the complaint the defendant moved for summary judgment dismissing the complaint. This motion was denied and the defendant appealed.
